Selling a Tenanted Property in Invercargill

Selling a rental in Invercargill or Southland involves the owner, tenant, property manager, sales consultant and legal adviser. Agree who coordinates each part before arranging photography or promising a settlement date. Start with the existing tenancy and the outcome you want: an investor buying with the tenancy continuing, or a sale requiring vacant possession.

Start with the tenancy, not a marketing date

Have the current agreement, variations, rent information and any notices available for your adviser. Identify whether the tenancy is periodic or fixed-term and check the relevant dates. Coordinate the local sales and management teams

Respect the tenant’s home

Owners must tell tenants in writing when the property is put on the market. Permission is needed for photography and buyer or professional access. Tenants can refuse photographs of personal possessions and set reasonable access conditions, including appointment-only viewings instead of open homes. Put the agreed access arrangements in writing, following the official guidance.

Plan the practical details together: contact person, proposed times, advance communication, keys, pets and which rooms or belongings need privacy. Tell the photographer and sales team about the agreed limits before they attend. Review marketing photographs for personal information, documents, family images and other identifying material. A tidy home for marketing must still be treated as someone’s current home.

Prepare a useful property information file

Organise the title information, council records you hold, chattels, known maintenance issues, work history and relevant assessments. Include healthy homes records and current insurance information for the rental, with qualified advice where required. Keep verified information separate from assumptions about consents, boundaries, access or future use. Your legal adviser can identify what needs to be disclosed or checked.

Discuss repairs with the manager before booking work. Record the intended scope, access arrangement, approval and completion evidence. Work through settlement and handover

If the tenancy continues, ask how the agreement, contact details, rent payment instructions, records and bond administration will be transferred. Verify any changed payment instructions through an established contact. Agree who confirms the new arrangements with the tenant and when. Avoid sending sensitive tenant records through a general website form.

If vacant possession is required, have your adviser check the tenancy position against the sale contract and proposed settlement. Confirm responsibility for notices, final inspection, keys and bond matters. Track the actual steps and outstanding issues rather than assuming the campaign or an accepted offer resolves them. A mutually agreed early end should be documented appropriately; it must not be treated as automatic.
